that tram ticket i got nailed for....in between weekly tix. honestly.
didnt realise that a law had been passed that allows trammies to ask for your ticket anywhere as long as they see you alight the tram....

I was approached about 6 meters away from the tram in bourke st mall by 4 undercover trammies! I protested (by trying to bolt no less) and was dealt with by 2 of them putting me in a arm lock type thing. im not aggressive or dangerous. i was humiliated with the heavy handed way I was treated. At least it made for some after work entertainment for those watching....:cry:

anyhow.

1 more gripe,... $3.10 2 hour tickets! its a really annoying amount of money to have in change.

I'm pretty sure they can't ask you once you're off the tram, only while on. I remember a guy once refused to show them a ticket because he wasn't on the tram. He had a valid one, but was going on principle. He won the case when they took him to court. I don't think that they were in the right somehow with you. I dunno.

221 (1) [subs (1) rep Act 101 of 2003 s 17, effective 3 December 2003] Travelling with a valid ticket.

(2) A person may make a journey in a carriage, or be on land or premises for entry to which a ticket is required, without a ticket if—

(a) prior to commencing the journey or entering that land or those premises he or she takes all reasonable steps to purchase a ticket; and

(b) while making the journey or being on that land or those premises he or she has no reasonable opportunity to purchase a ticket; and

(c) on completion of the journey or on leaving that land or those premises he or she takes all reasonable steps to purchase a ticket.

Essentially you can state that you have intention to purchase a ticket upon leaving the tram at the nearest Metcard outlet.

Thanks alot for that Lizkins. I didnt walk past a metcard outlet, but I didnt declare my intention to purchase a ticke either ?t:? . I was too busy getting angry. Im going to look into it further. For $150.00 it worth a bit more of a look into !

I also checked out some case law and although a couple of the judges took on their own interpretation as “questioning a passenger upon leaving the tram area”, they both agreed to wave the fee as it does state in the section I posted that you can be going to purchase a ticket. In one case the judge refused the person this exemption and claimed that there was not suitable evidence to show that he was intending to buy a ticket upon leaving the tram. The judge stated adequate proof would need to be provide to allow such an exemption, which he acknowledged would be somewhat difficult to prove but required.

I think your best bet would be to write a letter back telling your side of the story and also using an example of an instance where you could have been going to get a ticket as sanctioned in Section 221(2) of the Public Transport Act 2003. Any use of legal jargon always scares the willies out of em :) Plus I would at length describe the incident of how they physically handled you. It would be good if you got any of their names, but if you didn’t just use “authorised person”, and put it in quotation marks for good measure :D

Interesting stuff wit hthe train/tram tickets. After that guy fought the ticket on the basis of a loop hole the every reliable and honest bracks govgernment closed that loop hole quick than your could say "there will be no tolls on the scoreby freeway".

My gripe is similar to the pizza one. Its when your hungry and you eat hot chips but your to impatient to wait til they cool down that little bit. When they start going down your throat really hot and hurt like buggery going down but then you can't find a drink anywhere so instead the chip goes all the way down your throat burning like hell.

Hourly/daily/monthly tickets arent really used so much, you usually just pay from station to station, its hard to give an idea cos it depends where you are goin.

My monthly ticket to work costs about 210 bucks aussie

Got 2 teeth pulled on Thursday arvo. Bled for about 2 hours. No real pain during procedure, just the horrible wet-stick snapping sound when the teeth broke free.

Mouth feels like ninth layer of hell now. Centimeter deep holes in my gums. Doped up on Panadiene Forte. Amazed I managed to make it to Bad Company last night. Can't eat anything hard. Can't eat or drink anything hot. Can't stop fucking tounging the holes in my mouth.

The horrible thing is, it's all in preparation for braces in 2 weeks. Braces at the age of 22. Fuck.
