The legitamacy/legality of playing burnt CDs

Being a man of the world ( :oops: ) and what not, I have been to a number of 21th bday celebrations. Amongst these festivious events I have noticed a number of "johnny 1 bar mix" djs use burnt CDs of released material to play sets to the masses.

See that these "professionals" are getting paid for their services, I was wondering: are they legally able to use burnt copies of music to satisy the peeps' musical hunger?

Y'all might sense that I am slightly bitter, but still, does anyone know the legal side of this? Can I report the *(&ts? I have a business card...

Of course it's fucking illegal. It's pirated music. Piracy = ILLEGAL!!!

I would have thought it wasn't illegal if you had already bought copies of the originals at home.

you can use burnt cds provided you own copies of the original.
it's also illegal if the venue doesn't pay royalties to apra.

nah mate I'm sure you're allowed to make a copy and use it if you have bought the original. could be wrong but im pretty sure its not illegal to make a backup for yourself.

Sorry but it is true, I saw the making of the Labyrinth many many years ago.....they used someone elses hands to do the crystals.

it's illegal to broadcast pirate or retail material to an audience. i.e cd's/dvd's.

even if the dj brought the original cd and made a burnt cd. played the burnt cd instead. it's still illegal.

The rights of the content are held by copyright so unless agreements or permissions have been sorted. you can't broadcast either.

i think permission is needed if material is bought for work purposes. but i don't know how lax the legalities are in terms of enforcing mobile dj's to form agreements with distributors/publishers/artists...

maybe they legitimately downloaded the material????

I don't like DJs who use burnt stuff.... but.... can't rule out that MAYBE they are being legit????

i'd assume they'd have to go through APRA as well. Even little shops like cafes need to pay money to apra if they play cds.

This is an avenue I hadn't taken into consideration (mainly because neither myself or anyone I know downloads legitimately).

iTunes, Bigpond Music, Beatport and so on and so on.


But I'm with Hardy, don't know the legal implications of paying for MP3's then burning them to CD (media change) then playing out..

Look at it this way, there will always be people who pay for thier music, because they are passionate about it and want to support it.

I dont know about buying mp3's online, I would want my tunes on vynil or original cd, but thats just me.

I play stuff I have downloaded from strictly digital, BeatPort etc. all the time...usually because it's the only way the tune can be accesed. I usually tell the artist on other forums that I have done this and I enjoy their tunes. Their response is almost usually 'Thanx Heaps for your support!!'...not 'did u download it illegally??'. The mix below is 100% off cd's & sum of the artist contacted me and not asked have I ripped the tunes from sumwhere but gave me positive feedback about it. We are a community of music lovers not lawers......I wouldn't think anyone on here would be ripping tunes and playing them out.

Anyway, this guy seemed to be from a dj company, and had a whole folder of burnt compilations. I'm guessing these companies have got some deal where they can burn a certain amount of copies for their minions to use.

Probably legit, but still... :evil:

'fraid so, I saw the same "making of" many years ago and it was definitley another guys hand.

I don't know why but I've always thought the scenes with the cleaners in the tunnels would make good imagery for a metamucil ad.

I'm thinking of getting a cdj so I can learn how to use them when playing... the reason I want to is so I can play a wider range of music, stuff I wouldn't fork out $20 on for the 12" or couldn't find anywhere else but as a download - legit or not...

I'm not about ripping off artists, but I'd treat it the same as I do for CDs for personal use - I might download 20 albums and listen to them a few times, but if I really dig one/play it alot i'll go and fork out.

I hate the argument that downloads/burnt cds = lost sales for an artist. In most cases I wouldn't have gone and paid for the songs without hearing them anyway.

Once I know how to use the cdjs I'll be using a mix of legit downloads, my own vinyl rips, and pirate/burnt material, at least while I'm doing it as a hobby. Unless I start getting paid big bucks I don't have a problem with it, and I'd imagine most artists would be the same...

From memory you needed to get the shears from a vending machine and then a ring for the door or something like that. I think if you had told Hoggle to nick off then you couldn't get past that part.

Don't play songs you don't legally own kidz. You may not get caught, but doesn't it feel wrong? It would for me.

On the plus' of burning - we just got given Killing Sheep - Urban Affliction with privledge to play it out, probably about the raddest use for CDs.

Some of you really need to get with the times...

Johnnynostars, is your issue that the DJ you hired wasn't playing vinyl or that he may be playing pirated material? Do you feel ripped off that he didn't look cool enough playing CDs instead of spinning records?

CDs are the way of the future...they just make sense for DJs and labels. All the arguments about CDs not sounding as warm as vinyl went out the window when the cdj-1000 was invented...it actually supplements the frequencies that tend to be 'lost' in the digital format. Personally, I find it easier to mix on 1000s and throw in the loop, hot-cues and memory card and it is just a much better DJ tool.

However, its people like Penno (and others) who carry on with this "I'll illegally download it and maybe buy it later"...what a load of shit. But its pretty easy to spot a DJ playing illegal downloads...the quality is shit and a lot of producers put 'signatures' in their tracks (such as little skips, sounds etc.) and put them up on Soulseek so that the copies that are going around on there are obviously pirated. You don't see a lot of the high quality mp3s that people have legally downloaded end up on Soulseek.

When you can download top tracks for about $2 Australian, there really is no excuse for downloading illegally.

There are quite a lot of tracks that are only available on vinyl, which is why I still use both formats, but I think we will see more and more realeses in mp3 format.

I am, however, willing to acknowledge the other side of the coin. In a recent interview, Nubreed said that they believed their popularity in obscure Eastern European counties was due to people illegally downloading their tracks.

Also, I will acknowledge that most 12" are not supposed to played as part of a 'public performance'. I think we all know that this rule is not really enforced...

You just proved my point... I know I can download tunes for $2 but I think there is an excuse for not doing so, and that's quality, and choice. Instead of listening to the radio (mainly) I download music so I can choose the music I want to be exposed to. If I paid $2 for all the music I download I'd be broke, and wouldn't have listened to some of the awesome stuff that I have. So your musical exposure should be related to your bank balance? I pay for music when I think I should, which isn't always, so deal with it. I'd say alot of peoples first exposure to say an act like Nubreed would've been a set, album or track they downloaded, and I don't think they'd have a problem with it - most artists like exposure and in any case there are solid arguments that it's not going to hurt them financially, as their exposure grows.

A bit of a rant but I guess I don't think what I said before was a load of shit. I guess 'people like me' need to 'get with the times'.....

yeah...like, i dont dj or anything...but i still buy cds even though i have cd/ dvd burners...but people who actually make a profit off playing burnt cds should pay for them...like i do design like in photoshop and illustrator and i also do it at uni, and i have got them off other people or off the net etc...but seeing now people are asking me to do work for them ill probably have to buy thoes programs cause ill be making money off them

expecailly coming to software, even more so then just playing cds...cause software liences are $700 +

the first thing I do when I buy a CD is burn it and put the original away for safe keeping.

I've scratched, lost, spilt stuff on sooo many CD's, lucky I could just burn another copy.

and if any artist wants to chastise me for that then let 'em try.

What about this then? I play a lot of re-edits, bootlegs, mash-ups etc which I made from acapellas mixed with other instrumentals. Since you can't buy these forms of the song anymore (unless you bought the 12" or CD single in the short time it was commerically available), does that make it any less illegal?

I'm all for playing legal downloads, Mr. Buff, but until iTunes Australia/Bigpond Music et al start offering acapellas or instrumental versions, what can you do?
